Every claim in this chapter is traced to the source behind it. Below is each one, numbered as it appears in the book, with a link that opens the original.

  1. Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), Schedule 2, para 2(1): the value of a permanent resident's main or only home is disregarded "for a period of 12 weeks beginning with the day on which the adult first moves into accommodation in a care home."

  2. SI 2014/2672, Schedule 2, para 2(1), as above. The 12-week period runs from the date of the move itself, not from any earlier date on which a placement was discussed or agreed.

  3. SI 2014/2672, Schedule 2, para 4(1)(b) and para 4(5). The permanent disregard applies where the property is occupied by a "qualifying relative," defined as the adult's partner, a relative aged 60 or over, a relative of any age who is incapacitated, or a child under 18\.

  4. SI 2014/2672, Schedule 2, para 2(1). Once the 12-week period ends without a further disregard applying, the property's value may be included in the financial assessment from that point.

  5. The Care and Support (Charging and Assessment of Resources) Regulations 2014 (SI 2014/2672), reg 12, read with reg 25\. The upper capital limit for 2026/27 is confirmed at £23,250 by the relevant GOV.UK local authority circular for that charging year.
